Search extended for phone records for Mayor Winfield

A chase for Mayor Paul Winfield’s cell phone records in the sexual harassment suit filed against the city by his former chief of staff has been extended to a second service provider.

Attorneys for Kenya Burks have subpoenaed Ridgeland-based C Spire Wireless, formerly Cellular South, for Winfield’s call and text data for 2009 to 2011, according to court briefs. The former city employee has already asked the same from AT&T, a move the city’s lawyers have countered is irrelevant to the case and isn’t tailored specifically enough to the time during which Burks held her job.

Michael Winfield, the mayor’s brother and personal attorney, also has filed moves in the case to quash the pursuit of phone records from AT&T, echoing the city’s hired lawyers that it amounts to a “fishing expedition.”

A search of a cell phone number for Winfield noted in both the AT&T and C Spire subpoenas shows the number is currently licensed to Little Rock-based Windstream Communications. The company provides integrated voice, data and Internet services to customers primarily in rural areas.

Burks filed suit against the city Feb. 1 alleging she faced a hostile work environment, sex discrimination and retaliation due to a consensual sexual relationship with Winfield. Burks seeks damages under federal civil rights and constitutional law.

The city has until March 19 to respond formally to the suit. Gary Friedman, of the Phelps Dunbar firm in Jackson, represents the city. Louis H. Watson Jr., P.A., also of Jackson, represents Burks.
