A Vicksburg man accused of killing his uncle with an ax is set to stand trial in August.
Joseph Patton, 35, 209 Overlook Drive, stood before Circuit Judge M. James Chaney Jr. Monday for arraignment after indictment for murder by the January term of the grand jury.
Patton is accused of killing his uncle, Alfred “Pete” Patton, 62, by striking him in the neck with an axe in his mobile home on Nebula Drive off Oak Ridge Road in September 2015.
Family members found Patton’s body about 5:30 p.m. Sept. 22, Warren County investigator Chris Satcher testified two days later at Joseph Patton’s initial appearance. When Satcher arrived, Pete Patton was lying on the floor with the blade of a 26-inch Eastwing camping ax lodged in his throat.
The family had last seen Pete Patton on Labor Day.
“He was my Daddy, my friend, my hero, my everything,” his daughter Doris Patton said after the emotional initial hearing in September. Two family members collapsed to the floor before the hearing and had to be carried out.
At the arraignment Monday, two members of the family were present.
“He was such a nice person. I’m just numb. I’m shocked,” his sister, Dr. Mary Patton Rivers said in September by phone from Illinois.
Rivers said she was concerned that with the manner in which her brother was killed with an ax people would only focus on the shocking violence and forget his life of service.
“I want to put a face with my brother. He was a Vietnam veteran and a professional welder,” she said.
Pete Patton was a welder, though in recent years he was retired and disabled, family members said. He spent about eight years in the Army, his sister said.
“He loved his family. We loved him and we’re going to miss him dearly,” Rivers said. “He was one of the nicest persons you ever wanted to meet. He was very meek and quiet.”
