One man is dead and his grandfather is being treated for injuries sustained after a domestic assault turned deadly Saturday in Warren County.
At 11:44 a.m. Saturday, the Warren County Sheriff’s Office responded to a call of a reported shooting at 840 Culkin Road, Sheriff Martin Pace said.
Justin Daniel Kirkley, 25, 840 Culkin Road, was pronounced dead on the scene by the coroner, Pace said.
His grandfather, Joseph Orval Crist, 77, 840 Culkin Road, was suffering from contusions to his face, head and neck, Pace said.
An investigation into the incident indicates Kirkley was physically assaulting his grandfather and knocked him to the ground when the grandfather produced a pistol and shot Kirkley once in the chest, Pace said.
“We have had multiple disturbances at that house involving Kirkley,” Pace said, adding the most recent was in December 2015 when Kirkley was arrested for simple assault domestic violence.
“It appears Kirkley was living off and on with his grandparents,” Pace said.
Kirkley was out on bond for murder and is on probation for a burglary charge, Pace said.
Crist was transported to Merit Health River Region Medical Center and was being treated for his injuries, Pace said. He said Kirkley has been transported the state crime lab where an autopsy will be performed.
The investigation is ongoing pending the autopsy; however, Pace said at this time evidence indicates Crist was defending himself in his own home at the time of the shooting. Crist handed the weapon over to the first deputy on the scene, Deputy Silento McMorris. Detective Todd Dykes is the lead investigator of the incident.
“No charges have been filed,” Pace said.
