Vicksburg man says guilty in Rankin drive-by|[4/18/06]

One of two Vicksburg people indicted in a Rankin County drive-by shooting pleaded guilty Monday in Madison County, claiming sole responsibility.

Thomas Randy Clark Jr., 34, said he injured Susan Lee Wiltshire, 24, of Flowood while the two were in separate cars near Ross Barnett Reservoir shortly before midnight on the night of May 21.

Clark was accused of driving a Jaguar with Judith Kristie Smith, 38, as his passenger when a shot fired from a semiautomatic Glock 10-mm pistol he was holding struck Wiltshire. She was driving a Toyota Celica on Old Canton Road north of East County Line Road. It was not clear what may become of the charges against her.

Wiltshire was shot once in the left side, with the bullet entering through her arm, police reported. She was hospitalized for her injuries and then released by University Medical Center.

Wiltshire had two passengers in the Toyota but they were not reported shot.

The Toyota was at a drive-through window at a Krystal restaurant on East County Line when it was bumped by the Jaguar, investigators found. Harsh words were then exchanged and the Jaguar chased the Toyota from the restaurant, investigators also found.

Both vehicles were traveling north on Old Canton Road near Williams Boulevard, within about a mile from the Krystal, when the shooting occurred, investigators found.

A Madison County indictment charged both Clark and Smith with two counts each of aggravated assault and one each of drive-by shooting.

Clark’s guilty plea came during a status conference a week before his scheduled trial date, a spokesman for the Madison County District Attorney’s Office said.

A separate trial date, June 6, had been set for Smith.

Clark said during court Monday that he intended to display the gun and did not know it was loaded, the spokesman said. He also said Smith told him not to do it.

The drive-by shooting charge carries a maximum prison term of 30 years. Each aggravated assault count carries a maximum of 20 years.

Clark’s attorney entered his plea to Judge Samac Richardson who reportedly set a June 5 sentencing date.

Clark’s plea followed negotiations with prosecutors and was entered on agreements that any sentences he will receive on the charges run concurrently and that none exceeds 20 years, the district attorney’s office spokesman said.

Clark and Smith had been identified as partners in two Vicksburg businesses, including Manicures, Martinis and Magic, 1312 Washington St.

Smith is also an attorney who has had an office in Jackson and has also practiced in Warren County. She was said to have closed her Jackson law office, the district attorney’s office spokesman said.

Clark and Smith were arrested by Ridgeland Police near Harbor Drive and Lake Harbor Drive following the shooting, reports said.

Within about a week of the shooting Clark reported to Vicksburg that his home had been burglarized and that among items missing from it was a 10-mm Glock pistol. Clark has also said that that pistol was not the one that was used in the May 21 shooting, the spokesman said. Investigators have not recovered the pistol that was used in the shooting, the spokesman said.

Separate from the district attorney’s office indictment, Wiltshire has also sued Clark and Smith in Madison County Circuit Court. The suit asks for damages including &#8220damage to her vehicle; lost wages; hospital and medical bills, including three surgeries; permanent pain and suffering; permanent loss of strength to the arm; and loss of enjoyment of life’s activities.”

That civil suit remains pending and has been assigned to Richardson, Madison County Circuit Clerk Lee Westbrook said.
