‘Danger to community’ being held without bond|[8/23/06]

A Vicksburg man accused of shooting and wounding another while out on bond on a separate felony charge was denied bond Tuesday in Warren County Court.
Patrick Rader, 33, 119 Singing Hills Cove, will be held in jail on an aggravated assault charge that he shot John Hicks in the ankle, Assistant District Attorney John Bullard said.
Rader had been free pending resolution of a January 2005 indictment charging him with possessing 250 to 500 grams of marijuana when Hicks was shot on July 8. Rader was arrested Aug. 15 on the new charge.
District Attorney Gil Martin’s office and defense attorneys presented testimony Tuesday from five witnesses, including Lt. Billy Brown of the Vicksburg Police Department, before Judge Johnny Price of Warren County Court.
Afterward, Police Chief Tommy Moffett said he was pleased with the ruling. “There is no question in my mind that Rader is a danger to the community,” Moffett said.
Martin’s office filed its bond denial motion in county court because a dispute over who will hear proceedings in the marijuana-possession charge against Rader has not been resolved.
Circuit Judge Isadore Patrick accepted a guilty plea from Rader earlier this year, but then recused himself during a sentencing hearing. He said he’d been told the defendant was saying Patrick had accepted a bribe.
The case then fell to Circuit Judge Frank Vollor, who was asked by an attorney for Rader to recuse himself. The attorney cited a memo from Vollor explaining minimum sentences that would be imposed as part of guilty pleas in drug cases and said the memo meant Vollor was prejudging cases.
Rader’s request on that issue, filed with the Mississippi Supreme Court, remains pending. If the court grants Rader’s request, a judge from a separate jurisdiction would be appointed to conduct proceedings, at least in the marijuana case.
