Trial set for 2 men accused of shopliftingMen also face charges of kidnapping, robbery

Two men accused of a crime spree that involved kidnapping and robbing a 76-year-old Vicksburg man will stand trial in May for felony shoplifting.

Lance Burton, 25, 3700 Gowall Road, and Kody Goulette, 20, 107 Warren St., appeared before Circuit Court Judge Isadore Patrick Thursday to be arraigned after an indictment by the Warren County grand jury for felony shoplifting. Patrick set trial for May 28.

Burton and Goulette are accused of stealing a 55-inch Samsung television valued at $1,098 from Walmart Supercenter on Iowa Boulevard Sept. 16. Surveillance footage of the theft was discovered during an investigation into the kidnapping and robbery, part of which also occurred inside the store.

The kidnapping and robbery will be presented to the grand jury in January, District Attorney Ricky Smith said.

“That case needs a little more preparation due to the seriousness of the charge,” Smith said.

A second shoplifting case in which Burton and Goulette are accused of stealing a Dewalt saw and a Lincoln welder with a total value of $798 Sept. 15 at The Home Depot, 50 Halls Ferry Park Road, was expected to be presented to the grand jury Thursday afternoon, Smith said. The grand jury’s decision to indict or not will be made public this afternoon.

Burton, Goulette and Misty Lee, 21, 405 Timberlane Place are accused of kidnapping the 76-year-old Sept. 18 in the parking lot between Rainbow Casino and AmeriHost Inn, both in the 1300 block of Warrenton Road, police Capt. Bobby Stewart said. The man was alone at the time of the robbery, Stewart said.

Goulette pulled a gun on the man and robbed him of $190 before the kidnapping, Stewart said. Burton and Lee followed in another car as Goulette forced the man at gunpoint into Walmart, where he was forced to withdraw and hand over an additional $250 from an ATM at Woodforest Bank inside the store, Stewart said.

In another arraignment Thursday, a Vicksburg man accused of lying under oath to avoid jail time will go to trial in May.

Johnny Nevels, 42, 100 Chickasaw Road, was arraigned on a perjury charge related to a June 15 hearing to determine if he had violated probation by slashing tires in the 3000 block of Washington Street, according to court records. Trial is set for May 28.

Nevels testified that he was at work when the malicious mischief occurred May 9 and had been nowhere near Washington Street, according to a transcript of the hearing.

Blood found on the slashed tires has a 1 in 10 billion chance of not belonging to Nevels, according to a report by the state crime lab.

Burton, Goulette and Nevels were three of just a handful of defendants arraigned Thursday, as Patrick broke the traditional schedule of Thursday and Friday arraignments, Smith said.

Earlier in the week, Patrick sent a letter to the DA’s office ordering that defendants who already had attorneys be arraigned this week. Arraignments for indicted defendants who do not have an attorney are set for Nov. 9. Defendants with attorneys were arraigned Thursday, or were to be arraigned today.

“If you don’t have an attorney, you will have to come back next week,” Smith said. “This is the first time to do it this way.”

Other indictments, including name, age, address, the charge and arrest dates, released by the DA’s office following arraignments Thursday were:

• Albert Jones, 28, 525 Hartwood Drive — felony eluding a law enforcement officer, Aug. 29.

• Kevin Phillips, 22, 226 Greenbriar Drive — burglary of a dwelling; grand larceny, Aug. 21.

• Shaquille Ricks, 30, 4905 Halls Ferry Road, burglary of a dwelling; grand larceny, Aug. 21.

• Quentin Taylor, 21, 1211 Grammar St. — obstruction of justice, Aug. 10.

• Porter Thomas, 56, 316 Lake Hill Drive — possession of a weapon after felony conviction, Sept. 15.
