Child rapist faces 15 years after 2nd conviction

A convicted child rapist who served a prison term in the 1990s after admitting to raping a 10-year-old girl faces another potential 15-year sentence after being convicted this week of molesting another child.
Thomas Tubbs, 57, 906 National St., was found guilty by a jury Wednesday following a three-day trial in Warren County Circuit Court.
Jurors deliberated about two hours before returning the verdict, said District Attorney Ricky Smith, who prosecuted the case along with Assistant DA Lane Campbell.
Presiding Judge Isadore Patrick set sentencing for 9 a.m. Dec. 2, and Tubbs was immediately led across Grove Street to be held in the Warren County Jail.
Jurors, who were sworn in Monday, heard testimony from the now-5-year-old girl, her mother and grandmother, investigators and forensic specialists, including one who said a DNA test on the child’s underwear confirmed a match with Tubbs.
Tubbs did not take the stand, but three members of his family testified for the defense, said Smith.
Tubbs was arrested Dec. 21, 2009, several days after the child told her mother that Tubbs had touched her inappropriately.
This week’s was the second trial on the molesting charge for Tubbs, who had remained free on $100,000 bond following a December 2010 mistrial in which jurors could not reach a unanimous decision.
Tubbs pleaded guilty in 1993 to raping a 10-year-old girl and served about 10 years of a 25-year sentence.
Also in Warren County Circuit Court, Judge M. James Chaney arraigned additional defendants Monday who were indicted by the grand jury during its October term.
Indictments are not made public until defendants have been arraigned in court — formally advised of the charges against them — and assigned a trial date. About 70 indictments were made public last week.
The panel of 18 grand jurors was sworn in Oct. 31 and completed its service Nov. 4.
They reviewed evidence in 120 cases against 144 defendants, issuing indictments in 107 of the cases and returning 14 no bills. They reduced charges to misdemeanors in two cases and continued two others to the next term, which meets in January.
Defendants arraigned Monday and the charges against them are:

• Larry Lamar Floyd, 34, 141 Morning View Drive — driving under the influence, third offense, June 10.
• Gregory Ford, 35, 1101 Bowmar Ave., Apt. 2 — uttering a forgery, June 20.
• James Philip Johnson, 50, 100 Cossar Court, Apt. A — sale of a controlled substance, June 23.
• Jarrod G. Lee, 25, 1710 Bodley St. — possession of a weapon after felony conviction, March 8.
